I want to start a clothing label, how do I register the word in my label name?

My label name will be a new made up word that as far as I know doesn't exist. I have done some research and have also found the domain names are available. I will be initially based in Asia where my clothing will be made but will be hoping to sell to outlets worldwide. I really need to know what is my best bet at stopping people cashing in on my name should my business be successful. If my new-word is registered does that mean no-one can use it in website names, etc? Or do I have to register those said domains now? I hope someone can help. I will be based in Taiwan

  1. Where in Asia will you be based? In my understanding, you have to register that with your equivalent of the IPO (Intellectual Property Rights Office) as a patent for your label. As for your rights, I think you are limited to your industry. So, should someone from the food industry decide to use your name, I don't think you have any remedies available to you. There are, I believe, other circumstances that should be considered.

  3. Get a registered trademark and you should be fine. I forget what the laws are for international trademarks, talk to a trademark lawyer in your area for that, but don't rush it. Don't worry too much about people stealing it if you trademark it and get the website name. In most cases if you prove that you used it first, that's all you'll need to stay protected.

  5. That has been a problem facing companies from around the world for years! Pirates, it is the nature of the business, however secure the web domain name, and trademark the name in as many countries as you can afford. Wish you luck in your endeavor!!!
  6. Where exactly are you based in Asia? Each country has a Trademarks Office where you can register your mark as a trademark in respect of clothes. Inorder to do you you need to either contact local attorneys of each country and ask them to register your mark or contact a law firm like us who would simply give you the details of all the countries requested by you.
